ACADEMIC-INTEGRITY NOTICE

Exam Terminator is a fictional creative project and social experiment. It does not provide or endorse cheating, fraud, impersonation, unauthorized access, restricted test content or circumvention of examination rules.

Do not use the Site or Project Materials to violate any law, examination rule or academic-integrity policy.

1. About These Terms

These Terms of Use (the “Terms”) govern access to examterminator.com and any related pages, forms, interactive features, events, communications and materials that link to these Terms (collectively, the “Site”).

Exam Terminator is an independent creative project operated by Vertex Dynamics, a company incorporated in the British Virgin Islands under company number 2158720, acting through its authorized project representatives (the “Operator,” “Exam Terminator,” “we,” “us” or “our”).

The Operator’s authorization for the Project is maintained in its corporate and project records. Nothing in these Terms grants a visitor or participant any right to act for, bind, represent or make commitments on behalf of the Operator.

By accessing the Site, you agree to these Terms. If you do not agree, do not use the Site. If you affirmatively submit content, register for an activity, make a purchase or select an “I Agree” control, you confirm that you have read and accepted the version presented at that time.

Our Privacy Notice is incorporated by reference only to the extent permitted by law. Additional written terms may apply to a specific event, purchase, promotion, submission or participant activity. If those additional terms conflict with these Terms, the more specific terms govern that activity.

2. Definitions

“Project” means the fictional artistic, entertainment, educational-discussion and social-experiment project presented under the Exam Terminator name.

“Project Materials” means the Site and its text, graphics, scripts, videos, audio, fictional scenarios, characters, designs, downloads and other materials supplied by us.

“Submission” means text, images, audio, video, feedback, messages or other material a user sends to us or through the Site.

“Participant Activity” means any survey, interview, filmed or recorded interaction, staged scenario, study, user test, challenge or other activity identified as part of the Project.

3. Eligibility and Minors

You may use the general informational portions of the Site only if you can lawfully agree to these Terms.

You must be at least 13 years old to submit personal information through the Site. The Site is not directed to children under 13, and we do not knowingly collect their personal information.

You must be at least 18 years old to join a Participant Activity, sign a media or publicity release, make a purchase, enter a promotion with legal terms or submit identifiable audio, video or images—unless we first obtain documented consent from your parent or legal guardian and complete any additional process required by law.

We may request reasonable age or consent verification and may refuse participation.

4. Nature and Limits of the Project

The Project may use fiction, satire, dramatization, staged scenarios, hypothetical situations and commentary about education, pressure, technology, ethics and academic culture.

Project Materials are provided for entertainment, artistic expression and general educational or research discussion only.

We are not a school, university, admissions office, examination board, testing provider, law firm, mental-health provider or academic-writing service.

Nothing on the Site is legal, educational, admissions, testing, medical, psychological or other professional advice. We do not guarantee any grade, admission, examination result, skill, employment outcome or research finding.

5. Academic Integrity and Prohibited Conduct

You may not use the Site, Project Materials, a Submission or a Participant Activity to facilitate, request, advertise, buy, sell, obtain, disclose or attempt any of the following:

5.1 Cheating or Impersonation

Completing or arranging academic work, an interview, application, assessment or examination for another person; misrepresenting identity, authorship or qualifications; or evading proctoring or supervision.

5.2 Restricted Material

Obtaining, copying, publishing or trafficking in live, recalled, stolen, confidential, copyrighted or otherwise restricted examination questions, answer keys, marking schemes or candidate data.

5.3 Unauthorized Access

Accessing or attempting to access accounts, devices, networks, systems, locations, records or communications without permission; bypassing safeguards; distributing malware; phishing; credential theft; or surveillance.

5.4 Fraud or Unlawful Conduct

Forgery, bribery, extortion, deception for unlawful gain, harassment, threats, stalking, discrimination, exploitation or any violation of applicable law.

5.5 Harmful Instructions

Turning fictional or analytical content into operational instructions for wrongdoing, or helping another person conceal prohibited conduct.

5.6 Rights Violations

Submitting another person’s personal information, private communications, likeness, intellectual property or confidential material without a lawful basis and necessary permission.

Do not submit passwords, testing-platform credentials, government identifiers, payment-card data, medical records, live assessment content or another person’s sensitive information.

We may preserve and disclose information when reasonably necessary to protect safety, investigate apparent misuse, enforce these Terms or comply with lawful process.

6. Site Access, Security and Acceptable Use

We grant you a limited, revocable, non-exclusive and non-transferable right to access the Site and use Project Materials for lawful personal, noncommercial viewing and discussion.

You must not:

  • Interfere with the Site;

  • Scrape or harvest data except as allowed by law and our written instructions;

  • Defeat access controls;

  • Introduce harmful code;

  • Misrepresent affiliation; or

  • Use automated systems in a way that burdens or damages the Site.

You are responsible for activity under any account or access link assigned to you and must promptly notify us of suspected unauthorized use.

We may modify, restrict, suspend or discontinue any part of the Site without guaranteeing continuous availability.

7. Submissions

You retain any ownership rights you have in a Submission. You represent that you have all rights and permissions needed to send it and that it complies with these Terms.

You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format and transmit the Submission only as reasonably necessary to:

  • Operate, secure and moderate the Site;

  • Respond to you;

  • Administer the activity for which it was submitted; and

  • Comply with applicable law.

This operational license ends when the Submission is deleted from our active systems, subject to reasonable backups, legal retention and records of prior authorized use.

This Section does not give us permission to use your name, voice, likeness or private Submission in a publicly released film, advertisement, case study or promotional work.

Any such use requires a separate, sufficiently specific consent or media release, unless the content was knowingly posted to a feature clearly identified as public and the stated posting terms permit that use.

8. Participant Activities, Recording and Consent

Participation is voluntary.

Before a Participant Activity, we will provide any separate notice or consent materials reasonably required for that activity, including its:

  • Purpose;

  • Procedures;

  • Foreseeable risks;

  • Recording practices;

  • Intended audience;

  • Compensation, if any;

  • Data-handling practices; and

  • Contact information.

You may decline to participate.

These Terms alone do not authorize us to record private communications, use your likeness, disclose your identity or publish your participation.

When recording, identification or public distribution is contemplated, we will use a separate affirmative consent and, where appropriate, a media release. Consent may not be inferred merely from visiting the Site.

A creative or social-experiment label does not eliminate applicable consent, privacy, recording, safety, employment, school or research obligations.

If an activity uses delayed disclosure or staged information to preserve its integrity, any such use must be lawful, proportionate, designed to avoid more than minimal risk and followed by an appropriate explanation or debriefing.

Formal human-subjects research may require independent ethics or institutional review. These Terms do not determine whether such review is required.

Unless a separate signed agreement states otherwise, we do not guarantee that participation will be selected, published, paid, credited or kept available. We may stop an activity for safety, legal, editorial or operational reasons.

9. Intellectual Property

The Site and Project Materials are owned by, licensed to or used with authorization by the Operator and are protected by copyright, trademark and other laws.

Except for the limited right granted under Section 6, no right, title or license is granted.

You may not reproduce, publish, adapt, sell, sublicense, commercially exploit or create derivative works from Project Materials without written permission or another lawful basis, such as an applicable limitation or exception under copyright law.

“Exam Terminator” and associated names, logos, fictional characters and branding may be trademarks or source identifiers of the Operator. You may not use them in a way that suggests sponsorship, endorsement or official affiliation.

10. Third-Party Names, Links and Services

References to schools, universities, examination boards, testing companies, films, products or other organizations are for identification, commentary, criticism, parody, reporting or fictional context, as applicable.

Unless expressly stated, no affiliation, sponsorship or endorsement is implied.

The Site may link to or use third-party platforms. We do not control their content, security, availability or terms. Your use of a third-party service is governed by that provider’s terms and privacy practices.

11. Privacy and Communications

Our collection and use of personal information are described in the Privacy Notice at [PRIVACY NOTICE URL].

Do not rely on these Terms as a substitute for that notice.

If you contact us, register or submit a form, you consent to receive operational communications about that interaction. Marketing messages will be sent only as permitted by law, and you may use the stated unsubscribe method.

No online service is completely secure. You are responsible for choosing what to submit, and we encourage you not to send information that is unnecessary for the stated purpose.

12. Purchases, Consultations, Promotions and Rewards

If the Site offers paid products, consultations, tickets, memberships, prizes or rewards, the relevant page will state the material price, eligibility, delivery, renewal, cancellation, refund and promotion terms before you commit.

Those specific terms form part of the agreement for that transaction. We will not impose a recurring charge unless it is clearly disclosed and separately authorized.

One-time consultation fees are non-refundable once the consultation has been booked, reserved, commenced or delivered, except where a refund is required by applicable law or expressly agreed by us in writing.

Consultations, educational discussions and tailored plans are informational and advisory in nature. No particular academic, examination, admission, professional, financial or other result is guaranteed.

Unless a specific offer says otherwise, no Participant Activity carries payment, a prize, academic credit or other compensation.

Taxes, school approvals and employer permissions are the participant’s responsibility where applicable.

13. Copyright and Rights Complaints

If you believe material on the Site infringes your copyright, privacy, publicity or other rights, contact [LEGAL/PRIVACY CONTACT EMAIL] with:

  • Your contact information;

  • Identification of the material;

  • The location of the challenged content;

  • The basis of your claim; and

  • A statement that the information supplied is accurate.

We may remove or restrict material while reviewing a credible complaint.

This process does not waive any rights or create a representation that we qualify for any statutory safe harbor.

14. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE, PROJECT MATERIALS AND PARTICIPANT ACTIVITIES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

WE DISCLAIM EXPRESS AND IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY AND SECURITY.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS, OR THAT FICTIONAL OR COMMENTARY MATERIAL IS FACTUALLY COMPLETE.

Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

Nothing in these Terms excludes a warranty, remedy or right that cannot lawfully be excluded.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR AND THE PROJECT’S CONTRIBUTORS, CONTRACTORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST OPPORTUNITIES OR REPUTATIONAL HARM ARISING FROM OR RELATED TO THE SITE, PROJECT MATERIALS OR A PARTICIPANT ACTIVITY, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

  1. US$100; or

  2. The amount you paid directly to us for the specific product or activity giving rise to the claim during the 12 months before the event.

These limitations do not apply to liability that cannot lawfully be limited, and they do not limit obligations expressly accepted in a separate signed participant agreement.

16. Indemnification

To the extent permitted by law, you agree to defend, indemnify and hold harmless the Operator and the Project’s contributors and service providers from third-party claims, damages, liabilities and reasonable costs arising from:

  • Your unlawful use of the Site;

  • Your material breach of these Terms;

  • Your Submission; or

  • Your violation of another person’s rights.

We will provide reasonable notice of a covered claim and may control the defense while allowing you to participate with counsel at your expense.

This Section does not require indemnification for our own unlawful conduct.

17. Suspension and Termination

You may stop using the Site at any time.

We may restrict or terminate access, remove a Submission or end a Participant Activity when we reasonably believe it is necessary for safety, security, law, rights protection, project integrity or enforcement of these Terms.

Sections that by their nature should survive termination—including intellectual property, disclaimers, liability, indemnification and dispute provisions—will survive.

18. Changes to the Site and These Terms

We may update these Terms.

The revised version will state a new effective date and will apply prospectively when posted, except where law requires additional notice or consent.

If a change materially affects an active paid transaction or Participant Activity, we will provide any additional notice or choice reasonably required by law or the specific agreement.

Continued use after the effective date constitutes acceptance only to the extent permitted by law.

19. Disputes and Governing Law

Before filing a claim, you and the Operator agree to send a written description of the dispute and requested resolution to [LEGAL/PRIVACY CONTACT EMAIL] and attempt in good faith to resolve it for 30 days, unless immediate relief is reasonably necessary.

These Terms and any dispute or claim arising from or relating to them, the Site, the Project or the Project Materials are governed by the laws of the British Virgin Islands, without regard to conflict-of-laws principles.

Subject to any mandatory consumer rights or other rights that cannot lawfully be excluded, the courts of the British Virgin Islands shall have exclusive jurisdiction over any dispute or claim arising from or relating to these Terms, the Site, the Project or the Project Materials.

Nothing in this Section prevents either party from seeking urgent injunctive or equitable relief in any court of competent jurisdiction where reasonably necessary to protect intellectual property, confidential information, personal safety or computer systems.

20. General Terms

Entire agreement. These Terms, the Privacy Notice and any applicable specific written terms form the entire agreement concerning the Site and replace prior discussions about the same subject.

Severability. If a provision is held unenforceable, it will be modified only to the minimum extent necessary, and the remaining provisions will continue in effect.

No waiver. A failure to enforce a provision is not a waiver. A waiver must be written and applies only to the stated circumstance.

Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a reorganization, transfer of the Project or transfer of substantially all relevant assets, subject to applicable law and privacy commitments.

No agency. These Terms do not create an employment, partnership, joint-venture, fiduciary, franchise or agency relationship.

Electronic communications. You agree that notices and agreements may be delivered electronically where permitted by law. A printed version of an electronic record is admissible to the same extent as other business records, subject to applicable evidence rules.

Headings. Headings are for convenience and do not limit the meaning of these Terms.
